Nowadays, when it comes to deciding on the punishment for an individual crime, there is a disagreement between those who are in favour of a fixed punishment for each type of crime, and those who are in favour of taking into consideration the circumstances and motivation of the crime. This essay will discuss both sides of this argument, before giving a final opinion.

On the one hand, it is argued that a fixed punishment should be imposed for each type of crime. It is argued that this system is clear and transparent, as everyone knows what punishment to expect if they break the law, regardless of their individual circumstances. This system is also seen as being fairer, as it ensures that everyone is given the same punishment, regardless of their social class, gender or race. Furthermore, this system is seen as being more cost-effective, as it saves time and resources that would be wasted on lengthy court cases.

On the other hand, there are those who argue that the circumstances of an individual crime and the motivation for committing it should always be taken into account when deciding on the punishment. It is argued that this system is more humane, as it allows for a more tailored punishment that takes into account any extenuating circumstances. Furthermore, this system is seen as being more effective in reducing crime, as it allows the court to focus on the person’s rehabilitation, rather than just imposing a set punishment.
